Terms and Conditions - Orders (by mail or telephone)
General
The following general terms and conditions apply to all long-distance and external business relationships between 18FLAGS and the customer.
conclusion of contract
By placing an order in our online shop, the customer makes a binding offer to purchase the goods in the shopping cart. 18FLAGS will immediately inform the customer about the receipt of the order by e-mail.
The purchase contract is concluded upon payment or upon order confirmation. In the case of a purchase in the online shop with delivery, the customer receives the invoice by e-mail after the conclusion of the contract.

deliveries
When ordering a delivery, the customer receives an order confirmation after receipt. The order confirmation is a message generated automatically in advance, with which we comply with the legal requirement to inform customers that their order has arrived. The purchase contract is concluded upon payment or upon order confirmation.
Telephone order/order by e-mail
When ordering by telephone or e-mail, the customer will receive an order overview by e-mail after receipt. In addition, the customer receives a so-called payment link (request for payment) by e-mail. Until payment is made, the order is considered pending and will not be processed by 18FLAGS.

retention of title
The goods sold by 18FLAGS to the customer remain the property of 18FLAGS until the purchase price has been paid in full.
delivery time
18FLAGS delivers to any address by parcel service.
Small consignments are delivered to the customer by parcel service. The delivery time is currently up to 14 days, the customer will be informed of any different delivery times when the order is placed.
Prices
The prices indicated by 18FLAGS are gross sales prices. Legal sales tax included in the price. The statutory Austrian sales tax is shown separately on the invoices sent to the customer.

The delivery costs actually incurred are displayed in the overview and in the shopping cart during the ordering process.
payment
The delivery of goods, including shipping costs, must be paid for by the customer directly with the online purchase using PayPal or bank transfer.
Parcel deliveries are delivered by a parcel service provider and can only be paid for directly with the online purchase, including shipping costs, with PayPal or bank transfer.
In the event of a delay in payment, the customer is obliged to reimburse all costs associated with the collection of the claim (in particular collection fees and other costs, insofar as these were necessary for the appropriate legal prosecution) as well as statutory default interest.

The customer has the right to revoke this contract within fourteen days without giving reasons. The cancellation period is fourteen days from the day
a) to the customer or a third party named by him, who is not the carrier, who has taken possession of the goods if the customer has ordered one or more goods as part of a single order and the goods or goods are delivered in one piece or . will;

b) on which the customer or a third party designated by him who is not the carrier took possession of the last goods if the customer ordered several goods as part of a single order and the goods are delivered separately;
In order to exercise the right of withdrawal, the customer must inform us (18FLAGS, Michael Haidl, Wilhelmstrasse 15-17/25, 1120 Vienna, Tel.: +436764466888, email:18flags@chello.atby means of a clear statement (e.g. a letter sent by post or an e-mail) of the decision to withdraw from this contract. The customer can use the model cancellation form for this, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for the customer to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired.
Consequences of revocation
If the customer withdraws from the contract, 18FLAGS has all payments that 18FLAGS has received from the customer, including delivery costs (except for the additional costs resulting from the fact that the customer chooses a different type of delivery than the cheapest standard delivery offered by 18FLAGS has chosen), immediately and at the latest within fourteen days from the day on which 18FLAGS received notification of the cancellation of this contract. For this repayment, 18FLAGS uses the same means of payment that the customer used for the original transaction.
18FLAGS may refuse repayment until 18FLAGS has received the goods back or until the customer has provided proof that he has returned the goods, whichever is earlier.
The customer must return the goods immediately and in any event within fourteen days at the latestSending the declaration of withdrawalreturn. The deadline is met if the customer sends the goods before the period of fourteen days has expired.
The customer has the option of returning the goods to the 18FLAGS location at their own expense.
The customer bears the direct costs of returning goods that can be sent by parcel post. The customer also bears the direct costs of returning goods that cannot be sent as parcels (e.g. via a forwarding agent).
The customer only has to pay for any loss in value of the goods if this loss in value is due to handling by the customer that is not necessary to check the nature, properties and functioning of the goods.
Exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
warranty
In the event of defects in the goods, the statutory warranty regulations apply.
Limitations of Liability
18FLAGS is only liable on the basis of the provisions of the Product Liability Act and only in cases of intent or gross negligence.
Liability, compensation for consequential damage and financial loss, savings not achieved, loss of interest and damage from third-party claims against the customer are excluded in the event of slight negligence. The limitations of liability do not apply to personal injury or liability under the Product Liability Act.
Furthermore, 18FLAGS is only liable for its own content on the website of the online shop. Insofar as 18FLAGS enables access to other websites with links, 18FLAGS is not responsible for the external content contained there. If 18FLAGS becomes aware of illegal content on external websites, 18FLAGS will immediately block access to these sites.

18FLAGS informs the customer with the data protection declaration about:

Type, scope, duration and purpose of the collection, processing and use of the personal data required for the execution of orders and billing;

His right to object to the creation and use of an anonymous user profile for the purposes of advertising, market research and to tailor the 18FLAGS offer to needs;

the transmission of data to companies commissioned by 18FLAGS and obliged to observe the legal data protection regulations for the purpose and for the duration of the credit check and the dispatch of the goods. 18FLAGS will not share your personal information with any other company for marketing purposes.

the right to rectification and deletion of customer personal data stored by 18FLAGS.
Final Provisions
Austrian law applies to this contract.
Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions.
General terms and conditions valid for direct purchases
18FLAGS Terms of Service Direct Purchases:
In order for your order to be carried out, the delivery must be paid for in cash at the time of physical handover.
Please note when handing over: Check your goods for completeness and external defects.
Larger orders can also be paid for by bank transfer in the event of physical delivery, but remain the property of 18FLAGS until payment is received.
An exchange of goods that have already been delivered or handed over is excluded.
Cancellation of your order:
If you want to cancel an order that has already been placed, please contact our customer service as soon as possible on +436764466888. Freight or delivery costs already incurred will be passed on to you. Products that have been specially made for you are excluded from the right of withdrawal.
